Buyer Seller Policy/Order Terms Agreement

 
YOU AS THE CUSTOMER AGREE THAT BY PLACING AN ORDER ON BAREMINERALINDULGENCE.COM OR MINERALINDULGENCE.COM, YOU CERTIFY THAT YOU HAVE READ AND AGREE TO ALL TERMS AND CONDITIONS AND SHIPPING POLICIES AS DISCLOSED BELOW. CLARIFICATION IN REGARD TO OUR POLICY IS SHOWN BELOW AND TAKES PRECEDENCE OVER ANY INFORMATION TRANSMITTED VIA CORRESPONDENCE BY EMAIL OR PHONE OR BY ANY MINERALINDULGENCE/BAREMINERALINDULGENCE/NATURALLYFORMEKIDS REPRESENTATIVE. THE FOLLOWING POLICY RELATES TO ALL PURCHASES MADE ON EITHER WEBSITE. THIS POLICY MAY CHANGE OR BE UPDATED AT ANY TIME. WE ADVISE THAT CUSTOMERS/BUYERS REVIEW THE INFORMATION FOUND BELOW EACH TIME THEY MAKE A PURCHASE IN THE FUTURE.
 
Return Policy 
ALL SALES ARE FINAL. By placing an order on Mineralindulgence.com or Baremineralindulgence.com, you, as the customer/buyer, has full knowledge of the fact that due to the nature of natural hair and skin care products we DO NOT accept returns for any reason. There are NO exceptions to this policy. This is due to the fact that our products can not be resold after they have been delivered to a customer for personal use. 

Cancellation Policy 
We are proud to be the best selling natural hair and skin care product line for women and children of color. We appreciate the dedication of our customers and realize that their satisfaction is conducive to the longevity of our business. We strongly encourage customers to purchase sample products prior to purchasing full sized products to determine if they meet your specific needs. Orders that are canceled up to  24 hours after the order has been placed are subject to a 30% restocking fee. We do not accept cancellations after 24 hours. We reserve the right to limit and or restrict the sale of products under any circumstances.We reserve the right to deny sales transactions that we believe to be suspicious.  Any funds that have transferred to us and are subsequently realized to be under suspicious conditions will be refunded to the customer and the order will be canceled.

Shipping Policies
Orders ship in seven to ten business days. This schedule does not include weekends nor national holidays. All purchases include a transaction number automatically generated by Paypal when the order is initially placed on our website. This is your confirmation that we have received your order. We DO NOT send additional confirmations to customers unless we anticipate that an ordered item will be out of stock for more than five days after the order was originally scheduled to ship according to our regular shipment time. All packages are shipped by USPS priority delivery mail unless a special shipping service request is made by the customer/buyer. We reserve the right to ship via the lthe most practical method of shipment at our discretion that  would permit purchased items to be enclosed for safe delivery.  This method can sometimes mean that purchases will be shipped in sealed large size shipping envelopes.  If you as the customer/buyer would prefer NOT to have your purchase shipped in such a receptacle you may request special shipping services which would require an additional shipping fee. You may contact our sales department to have a seperate invoice sent to you to cover additional shipping costs. All packages shipped via USPS or UPS include tracking information for packages shipped with U.S destinations. It is your responsibility to stay aware of where your package may be during times of postal service processing and delivery.  A shipment notification is automatically generated and sent to the customer/buyer email address when the order has been scheduled for delivery. We advise customers/buyers to contact us if they have not recieved their package within ten days after the package was scheduled to be delivered.

We reserve the right to delay shipment for up to five business days beyond the regular shipping schedule if we anticipate that an item will be back in stock and available for shipment during that time. If an item is not available for shipment after day five, funds used to purchase out of stock items will be refunded back to the customer/buyer in the original method used for the purchase.

All orders will be processed during our second shift hours to insure that orders are filled and prepared for delivery to a local postal service prior to their daily cut off time. Due to the fact that we use a courier service to transport all orders to the postal service for delivery, all shipping costs include a small transportation fee.  Shipping costs for most U.S. destination packages is $9.99.  Orders that must be shipped via special delivery services which includes medium to large size boxes are $14.99 and up. If we anticipate that your order will require an additional shipping cost, you will be contacted by our sales department so that you may  remit any additional costs by invoice. We are an eco friendly company therefore we try to avoid using packing materials such as packing peanuts and foam at all times. Orders that are destined outside of the U.S. may be bubble wrapped for added protection when deemed necessary. Products that have the potential of leaking during transport are taped and shipped for normal processing and handling by the postal service.

We do not provide shipping insurance for orders. Customers may request Insurance or Signature Confirmation at their own discretion. These services are optional and must be paid by the customer/buyer. Charges for insurance or Signature Confirmation will be charged upon request. These services MUST be requested by contacting our sales department prior to shipment. If you as the customer/buyer fails to purchase insurance for covering lost items, damaged items, or misdelivered items, by completing any and all sales transactions with our company, you agree that we will NOT be held liable nor responsible for refunds nor replacements. 


Discounts and Special Sales Promotions
Sales promotions may offer precalculated shipping costs that will be credited  to eligible purchases accordingly. Credits will be processed and refunded upon shipment.  Any discounts, codes or promotional offers that are not entered by the customer in the designated comments field during checkout will not be honored at a later time. There are no exceptions. Free items are based on availability and are not eligible for same value promotions, credits nor rainchecks.  We reserve the right to restrict the usage of sale codes, promotions and or discounts. 

  
International Sales Policies

All prices are in U.S. dollars. All international orders require a $50.00 minimum purchase. International orders require paperwork that must be filled out by our courier service and processed in accordance to the U.S postal service policy therefore these orders are subject to a small transportation fee that is already included in quoted shipping costs.

We use USPS shipping via priority delivery mail as our regular method of shipping. This option does NOT provide insurance nor specific tracking information. You will have access to a copy of the shipment receipt provided by USPS upon your request up to 10 days after your order has been shipped. We do not have access to any other information other than that provided by USPS as it relates to packages that have already reached outside of United States boundaries. Orders under 4 pounds that consist of jars and bottles are securely wrapped in bubble wrap and shipped in a USPS envelope for items destined outside the U.S.  Larger orders are shipped in USPS boxes which generally causes an increase in shipping costs. If you as the customer/buyer prefer to have all packages regardless to size shipped in a box, you MUST submit a request for a special delivery service invoice to cover all additional costs. As the customer/buyer you are responsible for any and all import duties in your country. We will not lower the invoice value or send the order as a "gift" as a means to circumvent custom laws within your country.
 
Our shipping quotes DO NOT include customs, duties and taxes.  Any such fees or extra costs charged by agents within your country will be YOUR responsibility. You will need to contact your customs department in regard to extra costs and fees that they may charge for releasing your package to you in case your package is detained. 
 
If you prefer to have tracking information, you may request to have your package delivered by UPS (United Postal Services) or Fed Ex as opposed to our regular shipper. These shipping costs are generally more expensive and must be paid prior to shipment. Any broker or custom fees related to your purchase that are imposed within your country must be paid directly to the agency in your country for which we have no control.

Chargeback Policy 

Chargeback fraud has become one of the leading causes of losses for Internet based businesses around the world. It is a form of theft that inevitably causes a rise in prices for the average consumer and contributes to the need for additional security measures that may be bothersome for those who do not have dishonest intentions. A chargeback occurs when a customer contacts their credit card issuing bank to initiate a refund for a purchase they made on their credit card. Since chargebacks are costly and can add a considerable amount to our operating costs, which ultimately affect our ability to provide the best prices for our valuable customers, we will not tolerate chargeback abuses . ALL customers/buyers who file chargeback claims with the intent of circumventing our policy will be reported to the Chargeback Protection Project and other legitimate online merchant protection agencies which may affect the buyers ability to purchase from any other online retailers within the United States as well as other participating countries. In ALL cases, where a customer has filed a fraudulent chargeback claim with the intentions of circumventing our policy, due to changing their mind, not reading sales promotions, non compliance with shipping policy, or no longer wishing to receive the product for any reason, we will file a formal customer complaint and report with IFCC (Internet Fraud Complaint Center) during the initial stage of our resolution process.   In all cases where the chargeback is clearly fraudulent (such as item not received claims or partially or fully used products claimed to be damaged upon arrival) and with ill intent, we will file a report with the customer/buyers local law enforcement authorities. If the product was delivered via U.S. Mail we will also file a mail fraud complaint with the Postmaster and federal authorities. If in case a fraudelent chargeback claim results in the funds used to purchase items from Mineral Indulgence or Baremineral Indulgence being refunded back to the buyers account by their credit card issuer, we will immediately attempt to be reimbursed directly from the buyer. 

Reconciliation Regarding Payment Transaction Reversal and Chargeback Fraud

As the customer/buyer you are fully responsible for paying all monies owed to Baremineral Indulgence/Mineral Indulgence for products ordered from either of our websites. In respect of any payment made by you, you agree that you will not make any chargebacks, and/or deny or reverse any such payment and will reimburse our company for any charge-backs, denial or reversal of payments and any loss suffered by our company as a consequence of your actions or those of your credit card issuer.  In the event that payment of a shipped order is reversed by you or your credit card issuer, you are responsible for making payment to Baremineral Indulgence/Mineral Indulgence immediately.  Payment is due within 24 hours of any reversal.  Any past due amount will accrue a penalty of $3.00 per day until payment is made in full.  Delinquent accounts over 60 days are turned over to a collection agency for which additional charges that include collection agency fees, attorney fees, court fees and other applicable fees will be assessed and will apply according to any violated terms within our policy.   By placing an order on our website you as the buyer are fully aware that you are engaging in a buyer/seller transaction for goods for which payment is due prior to delivery. As the customer/buyer, you are hereby informed that if payment is not made according to the above mentioned terms, your name, address and any other identifying information discovered by our investigation will be reported to all major credit bureaus as a collection account. 

Defective Product or Not As Described Claims

 We advise that customers familiarize themselves with descriptions regarding products and inquire about specific details prior to placing an order. We also advise customers to purchase samples in case of uncertainty.  All products are tripled checked by our packaging department prior to shipment to insure that the products and packaging is not defective. As a security measure, our packaging department photographs all packages prior to shipment in stages of sorting, preparation for shipment and while sealed in thier respective shipping packages with identifying shipping labels in place. This information is retained for up to ten days after a customer/buyer recieves their order as a method of proof in regard to probable damaged upon arrival claims. In case a package is damaged or appears to have leaked during shipment the customer/buyer must file a complaint within 24 hours of recieiving their package and leave all containers and packaging in the manner in which they recieved it. Instructions for sending the package back to our regional shipping facility will be provided to the customer. Any shipping fees for sending the package back to our facility are the responsibility of the customer/buyer. A full investigation with results and a final decision will be made by our security department and correspondence will be sent to the email address used for placing the order within ten days. Packages that are damaged upon arrival and are later proven to have occured during transport by our courier service while in route to the United States Postal Service for delivery to the customer, will be replaced in the instance that they have not been used, opened, nor tampered with. If at any time, we believe that a claim has been filed for products that were opened, used or tampered with while in the custody of the customer/buyer we will not send replacements.
